Attorney Neidl presented oral arguments today, October 15th, on behalf of the New York State Senate before the NYS Court of Appeals in the Matter of Amedure v. State of New York (No. 126). The case centers on the constitutionality of a 2021 Election Law amendment, specifically section 9-209(2)(g), which permits disputed absentee ballots to be counted if one election official deems them valid. The plaintiffs argue this violates the New York State Constitution’s requirement for bipartisan action in vote qualification. A previous ruling from the Appellate Division upheld the statute, and attorney Neidl will argue the Senate's defense.
